Modenza London - Terms & Conditions.These terms & conditions of sale apply to all contracts between the seller, Modenza (we, our, us) and the buyer (you, your). We reserve the right to change or amend these terms and conditions. Any changes or amendments made shall come into effect on the day they are listed on the site .These terms and conditions, the use of this website and any legal actions arising out of any transactions shall be governed by English law and be solely within the jurisdiction of English courts. It is the buyers responsibility to read these terms and conditions. By using this site you agree to our terms and conditions. These terms and conditions do not affect your statutory rights. Price & Payment Goods are invoiced at the prices ruling at the time of order acceptance. Prices of our goods are subject to change without notice. Ownership Title of the goods remains with the seller until full payment and any outstanding balance is paid in full and the buyer is in receipt of the goods. VAT All our prices are fully inclusive of VAT unless otherwise stated on all goods or services within the EU. VAT will be charged in line with the ruling rate at the time of the initial order transaction. For all orders outside the EU, VAT is not added. For all orders outside the EU, VAT is not added. All local taxes and custom duties are the sole responsibility of the buyer. Cancellation & Returns Upon receipt of the goods, under the Distance Selling Regulations, the buyer has a 7 day cooling off period, in which to cancel the order, providing the goods are unused, undamaged and in their original packaging in a fully re-sellable condition. This must be with the prior approval of the seller. It is the buyers responsibility to keep all original packaging for at least 7 days, without this, refunds will not be possible. Cancellations must be made either, by telephone (0845 630 1214) or e-mail (info@modenza.co.uk). An email will be sent to you as confirmation , where by upon our acceptance, our carriers will arrange to collect said goods. The buyer must make the goods available for collection within 14 days of acceptance of cancellation. If the items are not in their original packaging, our carriers will refuse to take them and the buyer will be liable for any failed collection fee. Self assembly furniture cannot be returned once assembly is part or fully completed, unless there is a fault with the item. The seller shall not be liable for any damage to goods due to incorrect or incompetent installation as well as for misuse of the goods. Once the goods have been received by the seller from the buyer, they will be inspected and providing they are in (what the seller deems) an acceptable and re-sellable condition a refund will be offered. The refund offered will be 10% less of the total purchase price, this is to cover administration, insurance and shipping costs, this charge is non negotiable and will be deducted by the seller from the buyers original payment. This fee is not applicable to, what the seller deems, damaged or faulty goods, wherein a full refund or replacement of item will be offered and collection of goods will be at the expense of the seller. After placing your order there is a short period of time where you have the ability to cancel items free of charge - usually before the order is sent to the factory (made to order) or shipped (stock items). Once the order has progressed beyond this point a cancellation charge will apply. This charge shall not exceed 10% of the item cost. If it is not possible to prevent your order from being dispatched you can return the product in line with our returns policy. For buyers outside the EU all custom charges incurred for the return of goods will be at the buyers expense. Orders of custom made (made to order or to the buyers specification) goods may not be returned, but may be cancelled only at the discretion of the seller. However, in the event of acceptance of cancellation of custom made goods by the seller, 30% of the total purchase price will be non refundable and the buyer is responsible for all transport costs incurred. For the return of damaged or faulty custom made goods, there will be no charges made to the buyer, for administration or delivery costs, these will be met by the seller. For the purpose of health and hygiene, we are unable to offer refunds or replacements for beds or mattresses, unless, due to a manufacturing fault. It is the buyers responsibility to check all details on the order form are correct, including the dimensions and specification of the goods. We are unable to offer refunds or accept cancellations due to restriction of access or in the event of goods being unable to fit in required rooms. For made to order items, any amendments to the order must be made within 2 days of the original order being placed. Any amendments made after this 2 day period may not be accepted. Delivery, Storage & Inspection The seller will endeavour to complete delivery of any orders, on or before any estimated delivery times. However, any quoted times or dates for delivery given by the seller, shall be treated by the buyer, as estimates only. No liability can be accepted by the seller for failure to deliver at any estimated times or within any specified time howsoever caused. Delivery can only take place once the total balance has been paid. Our delivery charges at present are, for orders under £60 a fee of £7.50 is applicable, for orders over £60 or more delivery is free. These charges are applicable for deliveries to the mainland of England, Wales and Scotland only. The seller reserves the right to add a small surcharge for remote and hard to reach areas in Wales and North Scotland. For orders other than to these areas, the buyer should contact the seller for a quotation of delivery costs. Where a delivery date has been agreed by our carrier and the buyer, failure to meet this agreed delivery date by the buyer, resulting in a non delivery, will incur an additional delivery fee from the buyer of £49 to the seller. This charge is applicable to mainland England, Wales and Scotland. For all other destinations a non delivery fee of £75 will be applicable, where due to failure to receive an agreed delivery by the buyer. The buyer will be financially responsible for any storage required as a result of a failed delivery. Our storage charges are 3% of total cost of all stored items, per week, to be paid in advance to the seller. For all orders of more than 1 item, items will only be dispatched when all items are available for delivery, unless otherwise agreed with seller. Our carriers deliver to your door, or the properties main street door if in a multi occupancy dwelling. The carriers will attempt to locate the goods in a location of your choice if access and safety permits. It is the buyers responsibility to ensure access is free of any objects, especially fragile, valuable or breakable items. By requesting our carriers to attempt to bring items into your property, the buyer will be responsible for any damage caused, although, our carriers will undertake a reasonable course of action to prevent this from happening. Risk of damage to or loss of the products shall pass to the buyer upon delivery. In the event of a failed delivery caused by, what the carrier deems, limited access or on the grounds of health and safety, if the buyer is unable to store the goods whilst making necessary arrangements for any equipment needed or work required to insure access, the goods may be taken away at the buyers request whereupon the goods will be kept in storage and re-delivered when requested by the buyer, all storage and delivery costs will be the responsibility of the buyer. Our storage charges are 3% of total cost of all stored items, per week, to be paid in advance to the seller. The seller is not responsible for any loss or damage caused to goods whilst in storage. The seller will only hold items in storage for a maximum of 8 weeks unless otherwise agreed with the buyer, after this time the seller may sell the goods at the best obtainable price, deducting any costs incurred by the buyer. The seller will accept no liability for shortages or damages to goods unless the buyer notes any damage or shortages at the time of delivery. Where this is not possible, the buyer should sign the delivery form as Unable to inspect goods on delivery and must notify the seller of any shortages or damage within 72hrs of receipt of the goods .Whereupon, if repair to goods is not possible a replacement will be provided. Descriptions All measurements, descriptions, illustrations, images, weight, specifications, dimensions and drawings provided by the seller are approximate and intended for general guidance purposes only. They may be subject to change without prior notice to the buyer. Force Majeure The seller will not be liable for any delay, or failure in supply or delivery, or for any damage to goods as a result of any cause beyond it's control. Intellectual Property This site is owned and operated by Modenza UK Ltd and the information and material displayed are for non commercial use only. All images, descriptions, text, software, website design, graphics, logos, diagrams, trademarks and arrangement is the property of Modenza UK Ltd and it's suppliers and is protected by copyright laws.
